ALBANY, Ga. -- Spotted clutching his pants as they sagged five inches below his waist, exposing his underwear, an Albany man became the first cited under the city's indecent exposure, saggy pants ordinance, an Albany Police Department official said.
Jerrad LeConte Lewis, 21, received a citation from an APD officer at about 11 p.m. Tuesday for the offense, according to a police spokeswoman.
"The officer reported that she was patrolling in the area and saw a man who had a difficult time walking straight," the APD's Phyllis Banks said. "He was trying to hold his pants up, but they were about five inches below his hips, exposing his underwear."
According to the indecent exposure statute passed by the Albany City Commission Nov. 23, that is indecent and subject to citation.
The ordinance bans anyone from appearing in public "wearing pants or skirts more than three inches below the top of the hips, exposing the skin or undergarments."
Lewis can pay a $25 fine as a first-time offender. On subsequent offenses, the fine may be increased to $200.
The ordinance prohibits arrest or imprisonment for violations. But it also allows 40 hours of community service to be completed in lieu of fines.
Under the ordinance, "the municipal court shall have the same authority as the superior court to enforce obedience to its orders, judgments and sentences.".
