Man dead after altercation

ALBANY, Ga. -- A woman fatally shot her ex-husband in the groin and the chest with a handgun at 2414 Habersham Road after an altercation early Tuesday, said an Albany Police Department official.

Christopher Donaldson, 32, was taken to Phoebe Putney Memorial Hospital where he died from wounds inflicted by Marlina Hamilton, 33, said Phyllis Banks, police spokeswoman.

"At some point during a struggle, a handgun was fired and the victim (Donaldson) was struck," Banks said. "He was transported to the hospital but was later pronounced deceased."

Hamilton is housed at the Dougherty County jail but not charged, a jail spokeswoman said.

Albany police officers were at Hamilton's residence at 11:40 p.m. Monday on a domestic violence call, a police report stated. According to the report, the call was "unfounded."

Unfounded means there was no evidence there was a physical fight between Donaldson, who was labeled the aggressor in the report, and Hamilton, labeled the victim. With no evidence, no bruises, no broken furniture, the police made no arrests, the report added.

It was the third time this year that officers were called to the residence. The calls dispatched officers for domestic violence complaints on Oct. 1, 11, and 12, according to police dispatch.

Banks said officers asked Donaldson to leave the premises Monday, and

he did.

"Officers saw Donaldson leave and gave Hamilton resources available in domestic violence cases," Banks said. "The officers thoroughly spoke with her."

Reports state that about a half hour later, after midnight Tuesday, Donaldson returned to Hamilton's residence and was fatally shot resulting in the last domestic violence call.

Banks said that ownership of the gun used by Hamilton remains under investigation as does the motive for the fatal argument.
