ALBANY, Ga. — A Dougherty County jury found Tracy Smith, 33, guilty of aggravated battery and aggravated assault in the beating of Jerome Walden on June 24 at about 7 p.m. Tuesday.
Jurors deadlocked on a murder charge, according to Heather Lanier, chief assistant district attorney for the Dougherty Judicial Circuit.
Lanier said Judge Willie Lockette declared a mistrial on the murder charge. The District Attorneys Office plans to try Smith again for the murder with his co-defendants Demarcus Lewis, 20, and Calvin Brooks, 29. Sentencing on the two guilty charges will be scheduled for a later date.
Walden, 45, was found in an alley near the 1200 block of Highland Avenue. He was taken to the hospital suffering from swollen eyes, head and chest abrasions, a punctured lung, possible broken ribs and a head trauma. He died about 35 days later.
