Murder charge brought in Trayvon Martin case

JACKSONVILLE, Fla. — The neighborhood watch volunteer who shot 17-year-old Trayvon Martin was arrested and charged with second-degree murder Wednesday after weeks of mounting tensions and protests across the U.S.

George Zimmerman, 28, could get up to life in prison if convicted in the slaying of the unarmed black teenager.

Special prosecutor Angela Corey announced the charges but would not discuss how she arrived at them or disclose other details of her investigation, saying: “That’s why we try cases in a courtroom.”

Second-degree murder is typically brought in cases when there is a fight or other confrontation that results in death but involves no premeditation to kill. It carries a mandatory minimum of 25 years behind bars when a gun is used.

Martin’s parents expressed relief over the decision to prosecute their son’s killer.

“The question I would really like to ask him is, if he could look into Trayvon’s eyes and see how innocent he was, would he have then pulled the trigger? Or would he have just let him go on home?” said his father, Tracy Martin.

Corey would not disclose Zimmerman’s whereabouts for his safety but said that he will be in court within 24 hours, at which point he can request bail. He turned himself in in Florida.

Zimmerman’s new attorney, Mark O’Mara, said Zimmerman will plead not guilty and will invoke Florida’s “stand your ground” law, which gives people wide leeway to use deadly force without having to retreat in the face of danger. The lawyer asked that people not jump to conclusions about his client’s guilt and said he is “hoping that the community will calm down” now that charges have been filed.

“I’m expecting a lot of work and hopefully justice in the end,” O’Mara said.

On Tuesday, Zimmerman’s former lawyers portrayed him as erratic and in precarious mental condition. But O’Mara said Zimmerman was OK: “I’m not concerned about his mental well-being.”

Zimmerman, whose father is white and whose mother is Hispanic, has asserted since the Feb. 26 killing in Sanford that he shot in self-defense after the teenager attacked him. Martin’s family argued Zimmerman was the aggressor.

The shooting brought demands from black leaders for his arrest, touched off protests in which people wore hooded sweatshirts like the one the teenager had on, and set off a furious debate over race and self-defense that reached all the way to the White House, where President Barack Obama observed: “If I had a son, he’d look like Trayvon.”

Separately, the U.S. Justice Department’s civil rights division is conducting its own investigation.

Corey said the decision to bring charges was based on the facts and the law, declaring: “We do not prosecute by public pressure or by petition.”

One of the biggest hurdles to Zimmerman’s arrest over the past month was Florida’s “stand your ground” law, which affords strong protection to those who use deadly force.

Second-degree murder means a killing that was not premeditated but resulted instead from an “imminently dangerous act” that showed a “depraved” lack of regard for human life.

Some legal experts had predicted the prosecutor would instead bring a charge of manslaughter, which carries up to 15 years behind bars. It is defined as a death that results from a reckless but not a depraved act.

Corey repeatedly declined to answer questions about details in the case.

“So much information got released on this case that never should have been released. We have to protect this prosecution and this investigation for Trayvon, for George Zimmerman,” she said.

Legal experts said Corey must have compelling evidence against Zimmerman if she chose to charge him with second-degree murder.

“That indicates they have evidence (Zimmerman) was chasing Trayvon because he was black,” said Florida defense attorney Richard Hornsby. “It’s difficult to think how one prosecutor didn’t charge him at all and another thought there was enough evidence to justify a second-degree charge. It’s a pretty drastic swing.”

Tensions have risen in recent days in Sanford, a town of 50,000 outside Orlando. Someone shot up an unoccupied police car Tuesday as it sat outside the neighborhood where Martin was killed. And a demonstration by college students closed the town’s police station Monday.

But as the hour of the prosecutor’s announcement neared, the Martin family and their lawyer pleaded for calm.

Outside Sanford City Hall, Stacy Davis, a black woman, said she was glad to see arrested Zimmerman under arrest. “It’s not a black or white thing for me. It’s a right or wrong thing. He needed to be arrested,” she said. “I’m happy because maybe that boy can get some rest.”

Six weeks ago, Martin was returning to the home of his father’s fiancee from a convenience store with Skittles candy and ice tea when Zimmerman, the neighborhood crime-watch captain in the gated townhouse community, started following him.

Zimmerman told police dispatchers: “This guy looks like he is up to no good — he is on drugs or something.” The 911 dispatcher told him not to follow the young man.

At some point, the two got into a fight and Zimmerman used his gun.

Zimmerman told police Martin attacked him after he had given up chasing the teenager and was returning to his truck. He told detectives that Martin knocked him to the ground and began slamming his head on the sidewalk. Zimmerman’s father said his son suffered a broken nose.

Amid the uproar of the failure to arrest Zimmerman, the local prosecutor disqualified himself from the case, and Gov. Rick Scott appointed Corey, the prosecutor for Jacksonville, to take it over.

Corey has tried hundreds of homicide cases and is known for hardball tactics and her passionate devotion to victims’ rights. She said she met with Martin’s “sweet parents” and prayed with them.

“We only know one category as prosecutors, and that’s a ‘V,’” she said at the news conference, referring to victims, and making a V with her fingers.

My understanding is that Zimmerman did follow Martin to keep track while police units arrived to check out a suspicious character. 911 operator told Zimmerman not to follow. He broke off and turned to meet police at mail boxes. Martin doubled back and confronted Zimmerman. Sucker punched him and broke his nose. Then pummeled him. Zimmerman screamed for help, but Martin continued to beat him. Zimmerman shot Martin. Self defense. No probable cause for arrest. Black activists stir the crowd and state that Martin was shot down like a dog because he wore a hood or because he was black. Circus continues until Zimmerman is arrested today. That's how I reached my conclusion. Your mileage may vary.

No. If Martin had a reasonable suspicion that he was being stalked by an armed man - he would have been within his rights to defend himself and shoot the assailant. He had no duty to retreat under the Stand Your Ground law. But once you have escaped that danger and turn around and stalk and attack the "stalker", then he himself has a right to defend himself.

Wonder if they will be able to find him, no one seems to know where he is. I think this is the right thing to do, lay it all on the table, but with that being said, Zimmerman is unlikely to get a fair trial. I am sure there will be jurors that will be chomping at the bits to rule him guilty.

No doubt he is already ruled guilty to appease the protesters. I would hate to be in Zimmerman's shoes. He should have just ignored Martin and he wouldn't be in this mess.

A 17 year old was killed and was unarmed. But, the fact that he was black, some think that his life was worthless. IF only the Sanford Police had just at least taken the time and did a thorough investigation, and arrested this guy, perhaps things would have been different. They themselves could have asked for the State Attorney's Office to step-in. At least it would have APPEARED, as if they were trying to get the truth. If Martin attacked Zimmerman as he said, then they should have again at least offered a good investigative report. If Trayvon had been white and wearing a hoodie and died, Zimmerman would have been arrested and booked the same night. If Zimmerman had been black, and Trayvon white, he would have been arrested and probably dead by now. We all know it to be the truth whether you admit it or not. The point in all this is that if Zimmerman is innocent, prove it to all so the speculations, lies, wonder, guesses can stop. But, if that young man died a senseless death, at the hands of a trigger happy grown man because "he" looked like he was up to "no good", then he should be punished, and he will be whether in men law of God's judgment. The so called "Stand your Ground law is no more than a noose hanging from an oak tree, it’s just legal. Mrs. Martin will NEVER see her child again. She will never see his smile, touch him, or hug him. But, Zimmerman is alive, and he will be free. He won't get convicted, even if it goes to trial. If Caylee's jurors set her mother free after killing her, surely he will be set free. But, if you are a parent, you would want answers. You wouldn't want to hear about the so long law, but what happen to my child and the word of Zimmerman is not and shouldn’t have been enough to just walk away. Okay, he had blood on him, grass stains, and a broken nose. Trayvon is dead, and we don't know if he inflicted his own wounds or not. And if Trayvon was actually trying to get away from him after being attacked first, yes a struggle would ensue. Furthermore, if I understood his own brother, Zimmerman was not on duty as the watchman. But, again we need facts, and if the facts DO prove that Trayvon was the aggressor and attacked first, and then the family will be able to come to turns with the evidence and facts, and hopefully find closure and peace, oppose to just a corrupt system sweeping their child's death under the rug as if a dog. But, if any of you are parents or grandparents and YOU can truly say from your heart that if it were your child, same case, with Zimmerman, would you accept the police view of the case and just say, oh well, thank you very much. And if Zimmerman were black, and had killed your white child, would you accept their decisions. I think not, and better yet, you know not. If evidence shows that Zimmerman is innocent, then a free man he will be. But, regardless, no matter what he is going through now, or in the future can compare to what Trayvon has lost.... his life.

You have somebody on top beating you down, you are about to pass out, you realize you have your gun with you and you use it to get your attacker off. It's either kill or get killed. The statement is a result of your personal feelings rather than any facts available. “The point in all this is that if Zimmerman is innocent, prove it to all so the speculations, lies, wonder, guesses can stop.” -Here you suggest we abandon one of the most precious concepts of American justice! Of course if you think it better that criminals believe that the rest of us must scatter like scared rabbits when they threaten, so be it! The Falcon is back from his Sojourn, and it seems just in time to shed some light to the masses. I see this Travon Martin case has polarized the nation along racial lines. I can’t say that I didn’t see it coming. There is money to be made in racism; careers to be launched (or sustained). Ever noticed how many “activists” are coming out of the woodwork vying for their 15 minutes of fame, of which, media outlets are happy to oblige them.

To me, this whole incident stinks of something else and it has nothing to do with the color of skin. We know that the lead investigator wanted to file charges on Zimmerman; however, he was told by the states attorney that there was enough evidence. We know that Zimmerman’s father was well connected. He has gotten his son out of trouble in the past. To me, this whole incident is about classism, not racism; what being well connected can get you. However, taking abut classism isn’t sensational, because civil rights leaders benefit from classism as well. Jessie and Al have had legal and/or tax troubles seemingly disappear into the night. Troubles, the people they “lead,” could never make go away with such ease.

No. It is much better to make it about race. Race is emotional. Race gets people talking and arguing. Race sells newspapers and is good for television ratings. This is NOT true for classism. If Zimmerman had not been well connected, the states attorney would have taken the lead investigators word for bringing charges and that would have been that. Surely the investigator knew the laws. Surely this wasn’t the investigators first case. Wake up people. Stop falling for the banana in the tailpipe.

This is a victory for all the thugs in the world. So basically a thug can attack you and you have two choices, let yourself get killed or face murder charges if you try to defend yourself. I watched the interview that Piers Morgan had with Robert Zimmerman Jr. last night and he made a few good points. If his brother was going to commit murder, why would he call 911? Plus he says his brother told him he felt he was about to pass out any minute, he didn't have much time to think. It's too late to make the other decision after you are dead. Martin must have been a true coward having to attack Zimmerman from behind. A real man would have met him face to face, typical thug maneuver.

NOBODY on this board has all of the facts. I would think that the prosecutor knows more than anyone else in the case (except zimmerman....oh yeah, and coach, NOT). So, there must be something out there that would make her bring about a 2nd degree murder charge. Just by using the facts that are out there, one would think that 2nd degree would be hard to convict on. manslaughter seems to be easier. BUT, as I said, we don't know all of the facts. All we can do is guess by what we've heard. What I want to know is......What are all of these hood wearing, tea drinking, skittle eating, marching, protesting fools going to do IF zimmerman is found NOT guilty? will we see rodney king riots all over again? will they accept how the justice system played out? will they continue to call for zimmermans head if they don't like the verdict? Stay tuned.......

I agree! Nobody was there to know the real facts. Let just let it play out. He's been charged so there must be something that they know that we don't know. I guess we will all find out if and when it goes to trial. Let this story rest, it's getting old.

So now Trayvon's mother says all she wanted was an arrest and that she believe's the shooting was an accident and all she wants from Zimmerman is an apology.

Asked on "Today" what she would say to Zimmerman face-to-face, Sybrina Fulton said she wanted an apology, "I believe it was an accident. I believe that it just got out of control and he couldn't turn the clock back."

So now all of a sudden, she makes it sound like she doesn't think it was murder.

I am kind of tired of the whole mess. I think Mama sees $$$ signs, nothing more, and as I said before, if the Zimmermans get an aggressive defense attorney he is going to dispel the myth of Trayvon being an angelic young teen and expose him as a typical teenage boy, who talked the talk and walked the walk. I think Mama is going to be somewhat embarrassed when her son's social networking pages are shown in court, and I do think they will be, to show the jury the type behavior that Trayvon was capable of. Maybe he did provoke Zimmerman, maybe he did attack him, maybe the stand your ground effect was warrented...who knows.


I read there had been 8 burgarlies, 9 thefts, and a shooting in the last 13 months in the neighborhood where the shooting took place. The police had been dispatched 402 times during that period. No wonder they had a neighborhood watch.


Just imagine the riots if he is acquitted......Mostly rioters burn down their own neighborhoods. Makes for great entertainment on the tube and for heated discussion at the bars. Insurance rates go up, maybe, and a stray truck driver gets clobbered. WalMarts and 7-Elevens get trashed. The rioters get to mass update their home electronics at Best Buy and update their footwear. Added bonus: Jimmy Carter gets an opportunity to rebuild Habitats for Humanity.


Someone as a member of a community watch group in a gated community has the right to respectfully ask a stranger what they are doing. That stranger does not have the right to attack the person asking the question.


Do you see Florida Hispanics marching and protesting in favor of Zimmerman?

Say what you will, but Martin wasn't the innocent angel they tried to portray him to be. Even if Zimmerman was determined he wasn't going to let him get away and regardless what was said on 911 call, that does not prove that Martin did not attack Zimmerman. Martin's thuggish mentality was his downfall.

For one thing the EMT's cleaned him up, a broken nose can be put back in place and unnoticeable and the wound was in the back up his head so you would not see that in a mug shot picture. Ironically Martin is getting more rest than this story. Everybody making their own opinions. Let's wait for the trial when all the evidence is put on the table and whatever the verdict or ruling is respect that decision and let it rest. It's one person that got killed. The real crime was waiting 44 days to make an arrest. The only thing we really wanted was an arrest and let the court system play out. Zimmerman should not have been able to walk out of that police station after killing somebody, I am sorry. That is soo wrong. You know if it was the other way around, Trayvon would have never seen daylight again. But this is FLORIDA....remember the state that cant count votes, the Casey Anthony trial and screw ups....Jeb Bush etc......So, this case is still not over,because Florida is unpredictable. It's like I said earlier, people need to let the court decide his fate, respect that decision whatever it is. This is America, people are innocent until proven guilty. I do think the arrest was a little late in coming, should have been handled right away, not 6 weeks later. Even if he did shoot in self defense, there still should have been some type of hearing or trial to determine what happened. When you think about it, it does look like they were sweeping it under the rug. It looks as if they ask Zimmerman why he shot Martin..."Oh it was self defense"...oh, okay...you're free to go. I still maintain that nobody really knows what happened as no one was there except those two, but the case should have been handled more seriously than it was. Now it just appears they made an arrest to make it look official and to appease the crowd.
