Tribunal recommends Northside Principal's contract be renewed

ALBANY, Ga. — A state tribunal on Tuesday said the Dougherty County School System “failed to meet the required preponderance of evidence” of alleged CRCT cheating and grade changes by Albany High Principal Angela Shumate, unanimously recommending her contract for the 2012-13 school year be renewed.

Shumate was accused by a governor’s investigating team in a 2009 CRCT cheating probe that roiled the local school system. At the time, she was principal at Northside Elementary School.

While the outcome was a victory for Shumate, it’s still up to the DCSS School Board to accept the tribunal’s recommendation and offer her a contract.

“I am so excited, and God gets all the glory,” Shumate said after the tribunal’s announcement. “It will be so nice to have my life back. I enjoy working with children, and I am ready to get back to my students, faculty and staff.

“I would like to thank my supporters for all their words of encouragement during this difficult period.”

In December, Shumate was named in the final CRCT cheating report and was transferred to the system’s EPS (Exceptional Student’s Program), where she remained until her contract was non-renewed in June.

“We listened to the testimony and reviewed the evidence and did not find the required preponderance,” tribunal Chairman Gary Walker said when asked how the panel reached its decision. “The system’s attorney (Flin Coleman) did a good job of presenting his case, but the evidence was weak.”

Coleman, while disappointed in the outcome, agreed with Walker’s assessment of the evidence.

“Yeah, I’d go with that and would second his opinion of the evidence,” Coleman said. “I didn’t just make up the case. Some of the information we got from the GBI and the special investigators just didn’t match up. You see the result.”

Shumate’s attorney, Charles Cox of Macon, said he was pleased with the tribunal’s decision.

“We are certainly delighted with the results,” Cox said. “We think it was the right decision based on the evidence presented. This decision is what should have occurred, and we hope that the Board of Education will follow through with the tribunal’s recommendation.”

Coleman presented five witnesses for the system, while Cox countered with two witnesses and Shumate, who was the final person to take the stand.

Coleman hammered Shumate hard, implying she pressured teachers to make suggestions to students taking the CRCT tests.

Jane Hill was a proctor at Northside during testing in 2009 and testified that Shumate urged teachers to “do everything they could do to help her babies do the best they can do on the CRCT.”

Hill stressed that she saw nothing suggestive in Shumate’s pep talk, but added, “I can see how some people could interpret that statement differently than I did.”

Coleman also accused Shumate of changing teachers’ grades, a charge supported by former Northside teacher Tia Ford, who said the principal changed at least two students’ grades from a 54 and a 47 to 60s.

Ford said she confronted Shumate about the changes and was informed that “she (Shumate) didn’t need my permission to change grades.”

Shumate said she could not recall that meeting with Ford and denied ever changing teachers’ grades.

As the CRCT saga winds down, just four of the original 49 people named in the report have yet to have their cases resolved. That will change within the week.

This morning, Turner’s Nikki Lyons will appear before the tribunal; Jose Roquemore’s hearing is Thursday; Adrienne Savage’s is next Monday, and Beverly Knighton-Harris’ case will wrap things up a day later.

No way. If this is true then Dougherty parents must accept that sending your child to a public school here is less than worthless. It puts your child into harm's way and you cannot count on any authority to protect them when you are not around. If you care one iota about your child's well-being, keep them out of a Dougherty County school.

I guess Hooked on Phonics hasn't worked for you. You seriously want to punish a group of teachers (Most of which have only spent 10 minutes a day at the most carting those tests.), but you can sleep soundly about Whatley, Daniels, and Bridges. The gatekeepers? The three foxes in the hen house? The ones who worked long into the evenings and on weekends with those tests? The three people who spent more time nursing those tests at Isabella than anyone? The people who got incentives and bonuses for score? Right! This was never about getting the ones who hosted this party.

No, he doesn't approve of cheating! He also doesn't approve of letting the ones who orchestrated the cheating, sneak out of town, quietly. There is no way in hell 49 teachers got up one morning(in the same town but widely different schools) and decided, randomly, without discussing it, "Let's cheat!" What are the statistical odds of that? You can barely get three people who confer to keep a secret. Where did they meet to decide this was the year to go crazy? Where did the Principals have the staff gather to decide strategy? They had to have had a plan. Even in Atlanta, it couldn't be accomplished without well orchestrated groups, erasing parties, and those on the top levels overseeing it.

Toth and Walker worked together once on the Professional Standards Commission reviewing 1000s of ethics complaints against teachers. They should have a grasp of what constituted an ethical violation while serving on this tribunal. It appears Mr. Coleman had a weak case against the principal. The judges on the tribunal did not believe there was enough evidence against her. It is beginning to appear that Mr. Bowers' investigation was a waste of taxpayers money. Maybe the DOCO school board would be better served by allowing Mr. Bowers to prosecute the educators.

Has anyone wondered why the board offered a deal to the teachers that if they agreed on a monetary suspension they would be able to start work on July 31st and they took the deal and still haven't returned to work? They lied to the teachers to avoid a court date and made them seem like they plead guilty.
Terry, is there anyway you can find out what happened to the deal the board offered and and didn't live up to their side of the bargain? Are there any legal restitution for that? Why they are not making it public that they offered and promised them immediate restoration? I'm jst a

When this all started, it was predicted the Lawyers would work things out in a manner that was acceptable to their employers. Both the DCSS and the involved individuals. In other words it was rigged from the start. I still have a hard time believing the investigators just decided to accuse folks on the basis of no evidance. As we used to say years ago. A Policeman's job is to arrest the guilty, and let the Prosecutors and Lawyers deal them out.If you truely believe all these folks innocent, meaning they didn't do anything, I want to live in your wonderful world. I for one am realistic enough to understand the system around here and realize very few of the guilty are justly punished until the Father above sits in their judgement. Kind of reminds me of the old joke about Lawyers in Heaven.

They have tried to get selective amnesia on that score, but too many teachers have heard that drill in County wide meetings. When he Atlanta investigation was happening they went after the Superintendent that was in charge of the schools at the time with all they could. It's mighty strange that during the investigation of the Dougherty County school system Dr. Sally Whatley name is not hardly mentioned. Some people even go as far as to blame Dr. Murphee aka "ole #34. Are we plan by the same rules, or did she get special treatment

i have not read the investigation report. have you? MAYBE they did investigate her but they found nothing? i'm sure they investigated other teachers but they were not listed because they didn't find anything on them either. what some people are failing to realize is that there IS evidence against ALL of the 49......some more than others, but there is evidence! The ones with no evidence are not part of the 49. Even the tribunal chairman said that there wasn't a preponderance (great amount) of evidence against shumate and the evidence was weak......BUT there was still evidence. Come on, people!

The GBI investigators were a joke. I know of a teacher who was flagged with numbers that were unbelievable, as was her family member. She had only to sign a paper stating, "I swear on my honor I did not cheat." I'll let you guess what the criteria for signing that paper was.

You're commenting on another person's life and you have not even read the report? How do you know what evidence they have? Or, lack there of? You didn't read it! For your information tywebb, there were classrooms flagged of teachers who did not even administer their own tests. How would you like to be the teacher of record named in the report, but someone else gave the test? Is that fair? Or to be flagged for a child that was tested outside your classroom? Imagine having your name smeared all over the place, but you didn't test that child? Then you have two teachers on the list, one of whom was named because of a dispute over an Assistant Principal. That must have been fun for her, having her name thrown in because she caught him and her with their pants down.That report is the saddest joke of all.The whiners on here not only came late to the party...they arrived at the wrong address.

BUT it sounds as if they should've gotten you! you seem to know an awful lot about the whole situation. did the GBI talk to you? you could have told them how you know that whatley and others are guilty. Did YOU read the report? And why weren't teachers administering their tests back then? i know that after the scandal broke that teachers could not give the test to their own homeroom (or even grade) in my school. Please enlighten us, not with heresay and conjecture, but with evidence! And while you're at it, send a copy of it to the FBI. I'm sure they'd love to hear how the GBI is inept and racist (as you claim)

She knew and probably encouraged it. Coleman doesn't care about poor black children. He just wants his millions while these children miss out on an opportunity to have a decent life. Culbreath is so disillusioned that he's just glad to be mentioned in the same sentence with Whatley and Coleman. Parents have to demand better for their children. Their children are not someone's "babies" that people can toy with and cheat out of an education. They are the teachers' students and their parents' babies. It's time to call Sally Whatley out for the corrupt superintendent she was. She hired all those incompetent principals and gave them a greenlight to do everything but educate our children. I heard a white man say that slaves are like little children. You have to guide them. They can't think for themselves. As much as I hate this kind of talk, I have to admit that it holds a little truth. These slave principals didn't know how to run their schools so they took all their cues from their currupt superintendent who ultimately led them to the slaughter, but some of them were able to escape. But they ought to learn a lesson from this. Just try really hard to make a real difference in your schools. Practice servant leadership. Serve your students, teachers, parents, and the community. Don't take your position to mean that you can harrass teachers and not be held accountable. This is what you learned from Sally Whatley. Kids used to give teachers apples. Now they see that the apple doesnt fall far from the tree. Watching them rot from the top down. If I lived out of town I would subscibe to the herald just for a good laugh ...BOE.

I live out of town and this is good enough for me.....besides it is too expensive, the paper is a day late getting to the house via the USPS because there are so few rural paper delivery people....so this is good enough for me.....
