— Assistant Dougherty County Schools Superintendent Kenneth Goseer told a School Board Safety and Security Committee Thursday that the system had reimbursed bond money to the family of a student who was arrested by the DCSS police department.

"I am aware of one incident where that happened," Goseer said when asked by board member David Maschke whether system funds had been used to reimburse a student's bail money. "There was an incident of profanity directed towards a teacher at Dougherty (High) and she was arrested and sent to jail while wearing her ROTC uniform. We issued a check to the parents to reimburse then for the bond money for what we considered to be a bad arrest."

DCSS Executive Director of Finance and Operations Robert Lloyd confirmed that a check had been issued, but when asked the amount and who authorized the payment, Lloyd responded, "You'll have to ask Mr. Goseer about that."

When asked for his opinion on the reimbursement, DCSS Attorney Tommy Coleman told the committee that it was against the law to use school system money for anything other than educational purposes.

The Herald learned late Thursday afternoon that the Dougherty County District Attorney's office is now aware of the incident and is exploring if any violations of the law took place.

Board member Carol Tharin, also a member of the committee, was incensed by the admission.

"Somebody had to authorize this check," Tharin said. "I want to know who authorized it, the amount and will we be reimbursed?"

Maschke then instructed Goseer to ask Superintendent Joshua Murfree for a report on the matter, including reimbursement plans. Goseer agreed.

"I don't think this thing was very well thought out at all," Tharin fumed.

Goseer responded, "Well, I have just the opposite opinion. You don't understand the number of phone calls we get every day."

Maschke then expressed concern that the administration was acting on its own.

"I don't think the administration should be making unilateral decisions," Maschke said. "It's mind-boggling to me. We need to let people know we don't do that (bail reimbursement) anymore."

The revelation comes days after the school system was forced to turn over emails that showed Goseer, who was believed to have been working on behalf of Murfree, ordered DCSS Police Chief Troy Conley to run all warrants for arrest of DCSS students by Murfree's office before executing them.

When Conley balked at the idea, Murfree responded in an email to Conley saying that he just wanted to be kept informed of the department's activities because he was catching heat from people who he did not identify because he didn't know an incident had happened or because they thought he knew things that he didn't.

"I told the superintendent that he doesn't have the authority to tell the school police who to arrest or not arrest. The law is clear," Coleman said. "Our police department is certified by the state and swore oaths to uphold the laws of the state of Georgia. School system policy does not supersede that authority."

That prompted Maschke to ask, "So the school system police is an autonomous authority?"

To which Coleman replied, "This is correct. They have the authority to interpret the law as they see it."

"This whole incident is old news and overblown," Goseer said, referring to the March 15 emails. "It was sparked by the School Board wanting to be informed prior to the media getting it. We simply wanted to be notified of warrants and arrests."

Mascke interpreted the emails differently, specifically referring to a message from Gosser to Conley that read: "As of today March 15, 2012, there will be no more warrants or arrest made unless authorized by Superintendent Joshua Murfree. Please inform ALL Officers."

"I think the email is very clear," Maschke said. "We want make sure everyone is on the same page with this and understand that the superintendent doesn't have the authority on warrants or arrests."

Conley said his office has always provided the administration with brief incident summaries.

The meeting was delayed for nearly 30 minutes because Maschke said Conley and Assistant Chief J.C. Phillips had not been informed by Murfree that their presence was requested.

I believed the issues with the CRCT cheating were related to a bully mentality within the system (spurred on by the high degree of favoritism that exists). With this revelation, maybe the system is just an institution for a future of “how to break the law” with the desire to raise a generation that only expects to be allowed to do exactly what that want to do and nothing that they do not. Second chances are great, but the powers that be should have pooled their personal money to reach out to the one that was to be bonded – not use taxpayer’s money, or money taken from the funds not given to the teacher’s for their furlough days. No ownership of one’s actions, no consequences, no control. Yes the future is looking quite bright.

So, isn't it a violation of Policy, if not law for the DCSS to pay that Bond back to the Parent? Who will be repremanded, or charged with that offense? As far as I'm concerned, I know the law well enough to realize the Officer was using good judgement when the arrest was made. If more Officers followed that lead, the language used in this area would be a whole lot more presentable in Society. School isn't your backyard, or your home. The language you use there is your business provided it doesn't offend others. School is a Public enviornment, and as such is goverened by rule of law, code or statute.

It is illegal to use official DCSS funds to pay the bond back to the parent. And it is rotten, rotten public policy, as well as a violation of the school system's policy, although I'm sure it doesn't expressly state that "No school funds shall be used to pay for a student's bond who has been arrested by the DCSSPD." Who would actually believe that something of this nature would occur at the time policies and procedures were written and amended? No wonder #34's voice mailbox is full--I guess all parents think that the police should not be involved in their special snowflake's bad behavior.

Said student must have been a relative to one of the DCSS entities. No such behavior should by a student should be tolerated. The fact that the family did not support the school/police is demonstrative of the core of the problem.

It is so sad that on a daily basis we see how our tax dollars are being wasted in the school system. I say they need to clean house within the board, with Murfree included in that cleaning out process. And, it is sad that the school teachers are the ones who have to ultimately pay for this wastefulness. Clean out the administration, get a new Super., and get new people on the board. How can the school system reimburse a parent for bond of a child that was arrested? Who is doing the checks and balances within the system? NOBODY!! Just spend and spend the money that you do not have!!!

That is about the most IGNORANT thing I have ever heard. Who CARES what she was wearing. She used profanity with a teacher and went to jail. Her fault. So how was that a bad arrest? Just who do they think they are? I agree that they must know the parents of the child in question, but if she did the crime then she has to pay. SO SORRY. Teach your children to respect their teachers and any other adult in their life. I am so glad I do not have children in the DCSS!

Gee and people wonder how the CRCT thing could happen. Heck old #34 Murfree and his sidekick are making up rules as they go on things. Crazy. I would think that whoever authorized the check to basically reimburse a parent for getting their daughter out of jail. She was arrested by the DCSS Police for verbal abuse and cursing a teacher and probably threats and Murfree makes up a new policy to take DCSS monies from local tax paying citizens and pay her parent to get her back out of jail. Whoever authorized this and I suspect it was Murfree himself, should be FIRED immediatley. Heck stealing lunches vs, the Supt Murfree using tax money for jail bail is nuts. Remember Murfree came from ASU the same people that accidentally admitted 350++ students that did not meet minimum qualifications. Remeber he was ranked #34 on the hiring list. FIRE Murfree!!!!!!!!!

It's illegal for a student to direct a cuss word toward a teacher? Inappropriate? Sure. Violation of school policy? Absolutely. Against GA law? I'm not so sure. This is not to excuse the moronic actions of the school board, but I am curious what the charge was.

The policy does not start a student will be arrested for profanity. The police department is interpreting rules/laws as they see fit. This department needs new leadership QUICK, FAST and in a HURRY! They are out of control.

When someone uses profanity at another, especially a minor in the school system...it is considered inappropriate and an escalating behavior...as for the school police being out of control....it is just the opposite...they are maintaining control..and if you don't like it Support(what a name), then I suggest you remove your children from the school system, teach them some manners, or perform the teachers jobs....I am sure Support is part of the enetitlement community, who thinks they are never wrong and should never have be corrected or be held accountable.

Again, it may violate school policy, but is it a violation of LAW? One can not be arrested for profanity or inappropriate comments. That is why there must be more to the story. In fact, there are two separate stories here. One, why was someone ARRESTED for profanity? And two, completely another issue, why would the school system reimburse someone's bond money, regardless of why they were arrested?

If the profanity escalated into something more, which we don't know under the statements that were given, and Terry indicated there is more to the story that is not known by the public, a student can be arrested for "disruption of a public school". Whether the behavior qualified, I don't know, but I presume that's what it might fall under.

She did disrupt the class so an arrest was the proper thing to do. Where the problem lies is the parents. If I had done something like that when I was in school my father and mother would have NOT came to my rescue. Some parents are turning their kids into monsters. They must know how to behave in school and society so if the police must teach them that lesson then so be it.

It is so incompetent that this man contributed to a bond for a student to use profanity at a highschool teacher. Actually the student should have been punished severely and had her ROTC uniform stripped. I cannot believe the DOCO Schools have this caliber of person running the school system. DOCO schools operate under Murphee's Law. "What will we do wrong, we will do wrong all the time."

Geez, you would think she'd want the system that is governed by her and the rest of the Board members to follow the law or something. The nerve of her! (Eye roll) I truly cannot believe that someone thinks it is ok for a school system to use federal, state and local taxpayers' funds to reimburse parents for a BOND, under any set of circumstances, and that those who would like the law followed in this regard are "out of control". Actually, if you had more like her and Ealum, you wouldn't have the problems you have now. They would never have hired Murfree in the first place. I believe it is completely inappropriate to arrest someone for profanity. Is is equally inappropriate for the school system to fund someone's bond, regardless of why that person was arrested. The school system should have ZERO involvement in any law enforcement matters unless employees are specifically and officially questioned and/or subpoenaed as part of the investigative process.

She is using remarkable control. If I were serving on the DCSB someone would have to hog tie me and pull me out of the meetings. I would love to see Masche and Ealum join her along with any other board member wanting to see the administration re-directed. The law has been broken by Murfree ordering the police not to enforce the law. The law has been broken by using school funds for non-educational purposes. A school board member and a principal have been indicted on felony charges. Cheating on CRCT and the free meal program are rampant throughout DCSS. The Board is doing nothing under the leadership of James Bush and Joshua Murfree. There is sufficient reason for the governor to suspend the Board and implement restructuring strategies. If the governor does not intervene, we as a community should lawfully protest the school board through marches downtown during school board meetings. The press is doing its part to keep us aware of issues when they can obtain information as taxpayers we should do our part as well.

It is obvious some in DCSS think money can be used as desired but it can't--legally. The DCSS needs a"forensic audit" to see what is being done with our money,sooner rather than later. The usual financial audits made by the CPA firm don't catch these types of things. Can a grand jury force such an audit to happen?

As I have said before, write to the Governor instead of this forum. This is the only way we can get this group ousted once and for all. Everyone noticing its getting worse instead of better. Like a child the more they get away with the more they do wrong. This has to stop for the sake of our children, and the local goverment. Instead of lining the pockets of incompetent administrators at Central Office, maybe we should pay building employees their worth and get more bang for the buck! Bail the teachers out! Let's get a grant for that instead of free iPads for administrators.

I agree with your comment about "incompetent administrators" I would also add corrupt. Public schools need to pay more to effective teachers and pay less to coaches and athletic personnel. DCSS is top heavy at central office and everyone knows it.

If you teach for the DCSS, you have my respect. With all of the bad news we hear about CRCT, etc., there are teachers here who truly have a calling and do great jobs. Everyone thinks the hours are great, you have summers off, etc. when that couldn't be further from the truth. There are mandatory meetings, continuing education requirements and working to further your own education. You have to put up with more bad students than ever, sadly. This is not to mention other duties, record-keeping, tremendous pressure to conform to unrealistic ideals under "No Child Left Behind", etc. My parents are retired teachers. It's a slap in the face to teachers everywhere that a student curses a teacher (and may have caused additional disturbance), gets arrested, because under certain circumstances "disruption of public schools" is a crime and then gets bonded out by the very system that has to furlough teachers, etc.

Wow, a free iPad for administrators. That will ensure order in the schools!

Discussion about you "going away" has nothing to do with ethnicity, gender, or any other irrelevant topic. This discussion is about merit. Period. If you want the respect of those you "lead," then stop catering to the crowd whose attitude is one of entitlement and corruption. Think of the children we teach instead of the cohorts you associate with. You do that and your leadership will never be called into question.

Leadership does not mean that you have the right to not be criticized and questioned. If anything, the Constitution you ignorantly quote guarantees the citizens' right to question and protest when the government abuses their authority.

Joshua Murfree and Kenneth Goseer are not a part of the law enforcement branch and therefore should have absolutely no involvement with the school police department except for (appropriate) informational exchanges. The chief and board lawyer deserve "attaboys" for laying it out clear.

This is the opportunity to get rid of Murfree and Goseer and hopefully this will take the wind out of the sails on Bush who has remained very silent during all of this. I just wonder, if properly investigated, how deep these things really go and you, Greg, have the staff to do this without any conflict or if you want to back away, call the G.B.I. Basically it's simple. There is documented evidance this occurred, the check. Murfree and Goseer conspired to defraud the Public Schools by the misuse of funds, and did in fact do so. Ignorance of the law is no excuse. Prosecute them both.

I don't think so....Maybe a slap on the wrist or something, but aint nobody going nowhere until contracts end.....watch and see....No, I dont think what they did was right, but I doubt anyone will get removed for it....One of those administrators can pay the money back to the system out of their own paycheck and solve this mess if they wanted.
