City to settle with Jolivette

ALBANY, Ga. -- The Albany City Commission will vote at its business meeting tonight on a resolution that will settle three pending lawsuits fire department employee Roderick Jolivette has against the city.

According to the resolution, the city will pay Jolivette $185,000 from its risk management fund, and Jolivette will release all claims he has pending against the city and its officials and employees. Jolivette agrees not to seek future employment with the city, and he will receive additional years of credited service toward his pension as if he remained employed through his normal retirement date.

Jolivette has two suits pending against Albany Fire Department Chief James Carswell and one against the city of Albany. There is also an EEOC notice of charge that will be withdrawn as part of the settlement.

Contacted Monday afternoon, Carswell said he could not comment on the matter. City Manager James Taylor also declined to comment, but he said money for the settlement would not impact the city's general fund.

The settlement is the second Jolivette has received from the city, and he has also reached settlements with Dougherty County and Marine Corps Logistics Base-Albany.

More freebies and rewards for breaking the rules, but perhaps Albany comes out better this way in the long run.

HOPEFULLY NO ONE ELSE WILL BE STUPID ENOUGH TO EVER EMPLOY THIS JACKLEG. HIS REPUTATION WILL FOLLOW HIM. LET HIM CUT HIS OWN THROAT, BUT BLEED SOMEWHERE ELSE.

And don't forget the Jolivette in the CRTC scandal.....

waltspecht 1 year, 5 months ago

How many times has he pulled this type of thing, and profited from it. Until someone stands up and changes Tort to where looser pays things like this will continue. Lawyers on both sides will continue to profit from these suits, and the People will continue to pay.

Jovlivette, you know that you were wrong from the beginning. The only way that you got this settlement in Nathan Davis is just plain scare of a court battle along with our wonderful City Manager and the alledged "power to be" in city hall. It was easier for them to just give you tax payers money that paid the insurance premiums and probably a large sum from the city to just "shut" you up for the time, but I am sure you will be back with another law suit very shortly. This will catch up with you one day and my last statement is simple:

You are just living off of the legal system. Payback will come one day.

This clown lied, cheated and used taxpayers' money to help relatives during a flood, yet he gets $185k??? This does nothing other than sends a message to others out there that the City's checkbook is open and ready to settle. Fight this kind of garbage!

2

RedEric 1 year, 5 months ago

What was his argument? He didn't know the rules? Rules didn't apply to him? The city employees and equipment weren't doing anything anyway? You owe me because I am the hierarchy? What could he possibly say or do that would be worth $185k, plus full retirement? This is another one of those stories out of area people will not believe.

Welcome to Albany. Business as usual.

Whatever they had to pay is a bargain to be rid of this pos.

$185,000???? Am I reading this correctly??? Wow, so he gets rewarded for being a liar and a thief??? I seriously hope he doesn't receive a dime!!! The City shouldn't settle, he wouldn't win if this went to court because he was obviously in the wrong!

1

alleebrin 1 year, 5 months ago

If he were to go to court, he would be judged by a panel of his peers! What a joke!

Coach, I see something in this milk that is not clean. Vote Romney so we can return to the Bush era, or vote Obama for reel deal change!

It is a scam that they are taught at a early age , sue claim discrimination, racism everybody will run and hide, but before they do will get out the checkbook. It is time to stop and look at these scams to determine if they have merrit. Just watch TV (HAVE YOU BEEN INJURED,FALLEN,HURT,DENIED) ONE CALL

AND IT APPEARS THAT MOST OF HIS CLIENTS ARE BLACK IN THOSE COMMERCIALS. I'M ALL FOR VICTIMS TO BE COMPENSATED FOR DAMAGES AND INJURIES BUT THE PERCEPTION IS THAT A FENDER BENDER WILL HAVE YOU SET FOR LIFE. REALITY?: LOOK AT YOUR INSURANCE PREMIUMS.

WOW... He must have had something on somebody...For them to settle for $185,000 for him agreeing to drop his other two lawsuits!! there is something that someone in our city government is trying to keep from coming out... In my business experience, you dont settle a case for $185,000 that you know you can win!!!

1

bubbavet 1 year, 5 months ago

Nope. The city has always settled. They don't have a clue on winning anything.

2

spookj6 1 year, 5 months ago

Wow Albany and DOCO finest critics at it again. Maybe ya'll will realize that he was going to win his case and would have received a lot more money than the settlement paid. Chief Caldwell and the fire department has a lot of skeltons that would've came out. I know ya'll don't want to hear that but that's the true

3

bubbavet 1 year, 5 months ago

His present and former chief failed to do their jobs because they new what the outcome would be. That said, it still wasn't right for them to let him slide. The taxpayers always have to foot the bill.

I think I may just try to file a lawsuit against Albany just for the heck of it. Maybe I could get settled for $185,000.

Amazed2 1 year, 5 months ago

Oh yea sides having the best government housing and assistance programs in de Good Life City we have the fastest easiest and best payout for frivolous lawsuits in the entire southeast. Who said we aint Number One!!

1

Amazed2 1 year, 5 months ago

Heck even Tommy Coleman could have negotited this one down. But Albany dont want to fight nothin.

Duane_Kelley 1 year, 5 months ago

Help me out...what exactly did Mr. Jolivette do wrong if he continues to win lawsuit after lawsuit? To me it seems that the blame lies other places than where some of you are pointing. A 2009 charge dismissed and reinstate him at a paygrade 4 levels lower than his original pay? To me it seems there was a personal vindetta against him and he would not stand for it....If he did screw up then there was ineptitude by his superiors and in order to cover up there errors a settlement was reached....Now if you believe he indeed got away with something then imagine if he got close to a quarter of a million dollars from the city what he must have had on the higher ups? He was in position to get even more if it went to trial. Just accept the fact that the city screwed up and may have tried to cover up.....and as far as people being taught at an early age Mr./Mrs tiredofit....you would make those claims and state your name which to me are borderline prejudiced....which to me is clearly a cowardly act.

VSU 1 year, 5 months ago

This whole fiasco started when Jolivette used a firetruck and equipment and I believe other firemen to clean out a relatives house that got flooded without permission from the fire chief, if this helps answer part of your question. at least this was the beginning of a chain of events.

2

Outtahere 1 year, 5 months ago

Duane,

VSU is correct about where the chain of events began. It began with him using City resources for personal use. BUT... I do think there were some things going on in the background that we didn't and won't know about. The City screwed up on this one.

1

tiredofit 1 year, 5 months ago

DUane it may be borderline prejudice, but it is sad, but true. It is not a cowardly act to speak the truth. How many lawsuits has Albany had to settle.

1

dmyers80 1 year, 5 months ago

I agree 100% with Duane...As in my previous post, now Im neutral on the matter but I do believe that more than jolivette would be out of a job if all the facts came out in court.... and tiredofit...what do you mean is a scam THEY are taught at an early age???

Albany "The lawsuit City"

0

waltspecht 1 year, 5 months ago

No, Albany the coverup City! There are enough skeletons in closets around here that Halloween shouldn't go lacking for any for display. All the way from Swining Pools at cost to avoid DUI to the super purchase priceof a used / almost new automobile. Then there were those City Garage parts bills for types of Cars the City didn't own. Or how about personal cars getting washed and waxed on County time? If I have knowledge of these rumors, what do you think an insider would have? It is still wrong to settle these suits without a fight, as most of the culprits are either retired or gone.

Any sorry sack of crap that gets "settle-ments" from FOUR SEPARATE ENTITIES IN THIS PODUNK TOWN has got to be a walking sheister who is only out for THA SUE MONEY!!

Jovi was also charged for basically identifying himself as a police officer to another officer who stopped him for speeding. I think they call that impersonating a police officer. The officer that stopped Jovi asked his Captain about Jovi later in his shift and the Captain called the Dougherty Sheriff Kevin Sprull. Of couse the sheriff told them the real story that Jovi was lying and he was only a local fireman. At one point charges were pending but I do not know final status.

He doesn't need to work anymore. He has screwed the taxpayers for enough to retire. Worthless.

0

saveourcity 1 year, 5 months ago

I disagree. That money will be gone in 6 months. Then he will find someone else to sue

1

Citizen_A 1 year, 5 months ago

He'll sue us commentators for defamation of character....

0

bubbavet 1 year, 5 months ago

If you knew all the things he got away with before all this took place you would not believe it. His Chiefs let him slide because they knew he would and did use race on everything. He was also arrested on the job for having a gun used in a crime. Charges were later dropped. He said he bought the gun. He didn't know it was stolen and used in a crime.
