ALBANY, Ga. -- The Albany City Commission will vote at its business meeting tonight on a resolution that will settle three pending lawsuits fire department employee Roderick Jolivette has against the city.
According to the resolution, the city will pay Jolivette $185,000 from its risk management fund, and Jolivette will release all claims he has pending against the city and its officials and employees. Jolivette agrees not to seek future employment with the city, and he will receive additional years of credited service toward his pension as if he remained employed through his normal retirement date.
Jolivette has two suits pending against Albany Fire Department Chief James Carswell and one against the city of Albany. There is also an EEOC notice of charge that will be withdrawn as part of the settlement.
Contacted Monday afternoon, Carswell said he could not comment on the matter. City Manager James Taylor also declined to comment, but he said money for the settlement would not impact the city's general fund.
The settlement is the second Jolivette has received from the city, and he has also reached settlements with Dougherty County and Marine Corps Logistics Base-Albany.

How many times has he pulled this type of thing, and profited from it. Until someone stands up and changes Tort to where looser pays things like this will continue. Lawyers on both sides will continue to profit from these suits, and the People will continue to pay.

Jovlivette, you know that you were wrong from the beginning. The only way that you got this settlement in Nathan Davis is just plain scare of a court battle along with our wonderful City Manager and the alledged "power to be" in city hall. It was easier for them to just give you tax payers money that paid the insurance premiums and probably a large sum from the city to just "shut" you up for the time, but I am sure you will be back with another law suit very shortly. This will catch up with you one day and my last statement is simple:
You are just living off of the legal system. Payback will come one day.

What was his argument? He didn't know the rules? Rules didn't apply to him? The city employees and equipment weren't doing anything anyway? You owe me because I am the hierarchy? What could he possibly say or do that would be worth $185k, plus full retirement? This is another one of those stories out of area people will not believe.

It is a scam that they are taught at a early age , sue claim discrimination, racism everybody will run and hide, but before they do will get out the checkbook. Help me out...what exactly did Mr. Jolivette do wrong if he continues to win lawsuit after lawsuit? To me it seems that the blame lies other places than where some of you are pointing. A 2009 charge dismissed and reinstate him at a paygrade 4 levels lower than his original pay? To me it seems there was a personal vindetta against him and he would not stand for it....If he did screw up then there was ineptitude by his superiors and in order to cover up there errors a settlement was reached....Now if you believe he indeed got away with something then imagine if he got close to a quarter of a million dollars from the city what he must have had on the higher ups? He was in position to get even more if it went to trial. Just accept the fact that the city screwed up and may have tried to cover up.....and as far as people being taught at an early age Mr./Mrs tiredofit....you would make those claims and state your name which to me are borderline prejudiced....which to me is clearly a cowardly act.

This whole fiasco started when Jolivette used a firetruck and equipment and I believe other firemen to clean out a relatives house that got flooded without permission from the fire chief, if this helps answer part of your question. at least this was the beginning of a chain of events.

VSU is correct about where the chain of events began. It began with him using City resources for personal use. BUT... I do think there were some things going on in the background that we didn't and won't know about. The City screwed up on this one.

No, Albany the coverup City! There are enough skeletons in closets around here that Halloween shouldn't go lacking for any for display. All the way from Swining Pools at cost to avoid DUI to the super purchase priceof a used / almost new automobile. Then there were those City Garage parts bills for types of Cars the City didn't own. Or how about personal cars getting washed and waxed on County time? If I have knowledge of these rumors, what do you think an insider would have? It is still wrong to settle these suits without a fight, as most of the culprits are either retired or gone.

Jovi was also charged for basically identifying himself as a police officer to another officer who stopped him for speeding. I think they call that impersonating a police officer. The officer that stopped Jovi asked his Captain about Jovi later in his shift and the Captain called the Dougherty Sheriff Kevin Sprull. Of couse the sheriff told them the real story that Jovi was lying and he was only a local fireman. At one point charges were pending but I do not know final status.

If you knew all the things he got away with before all this took place you would not believe it. His Chiefs let him slide because they knew he would and did use race on everything. He was also arrested on the job for having a gun used in a crime. Charges were later dropped. He said he bought the gun. He didn't know it was stolen and used in a crime.
