ALBANY, Ga. — Tracey Smith, 35, has been convicted of felony murder and awaits sentencing next week.
Smith's earlier trial for the death of 45-year-old Jerome Walden ended in a mistrial, Dougherty County District Attorney Greg Edwards said. Smith and his attorneys had appealed to the state, claiming that Smith could not be tried again on the same charges. The appeal was denied, Edwards said, and Smith was once more tried in the Superior Court of Dougherty County.
After hearing the testimony, the jury began deliberations Wednesday afternoon and returned with a guilty verdict Thursday morning.
Smith and two other men were arrested for the June 24, 2011 beating death of Walden in an alley off Edgerly Avenue.
"Tracey Smith was the person who actually held the board with nails in it and did the beating," Edwards said.
