Mother files suit against officer

ALBANY — The mother of a woman injured after being shot by a police officer in 2006 has filed suit against the officer and the city of Albany, court documents show.

Filed Thursday in Dougherty County Superior Court, Alice Mae Warren, the mother of Alice Michelle Warren, claims that Albany Police Officer Vy Chu used “unnecessary, offensive, totally unjustified and unprovoked,” actions when he shot her daughter in the chest while searching an abandoned house in 2006.

According to police officials, Warren’s daughter was “lying in wait,” in a closet inside the home and leapt out at Chu as he was walking through the home.

The suit claims, however, that Chu had no right to have unholstered his weapon, clicked off the safety and then fired at the woman. Warren is seeking compensatory and punitive damages, to be determined by a jury, court papers show.

Alice Mae Warren took custody of her daughter March 31, 2008, after petitioning the probate court to award her legal guardianship because her daughter was suffering from “psychosis with hallucinations,” court documents show.

Chu, who is still on the police force but assigned to work with the Albany-Dougherty Drug Unit, was investigated by the GBI but was never charged with criminal act.

The suit claims that Warren was “grievously” injured and experienced extreme pain and suffering while hospitalized and incurred medical costs of more than $27,000.
