STATE OF GEORGIA COUNTY OF CALHOUN NOTICE OF SALE UNDER POWER Because of a default in the payment of the indebtedness secured by the Deed to Secure Debt executed by EDWIN B. WIMS to COMMERCIAL STATE BANK dated October 12, 2007, and recorded in Deed Book 160, Pages 553-554, Calhoun County, Georgia, Deed Records, said Deed to Secure Debt securing a Note in the original principal amount of $47,444.08 dated October 25, 2018. Commercial State Bank as the holder thereof pursuant to said Deed and Note, and all extensions thereof, thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deeds, will on the first Tuesday in the month following the publication of this notice, being September 3, 2019, during the legal hours of sale being 10:00 a.m. through 4:00 p.m., before the Courthouse door in Calhoun County, sell at public outcry to the highest bidder for cash, the property described in said deed to wit: All that tract or parcel of land lying and being in the 3rd Land District of Calhoun County, Georgia, and in the City of Arlington, more fully described as follows: City Lots 22, 24, 26 and 28 of Block "O" shown by the City Property map of the City of Arlington, and improvements located thereon identified as 136 Martin Luther King Street, according to the present system of numbering streets in the City of Arlington, Georgia and presently identified as 393 Martin Luther King, Jr. Drive according to the present numbering systems for streets in the City of Arlington. Property Address: 393 Martin Luther King Street f/k/a 136 Martin Luther King Street Arlington, Georgia 39813 Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deeds to Secure Debt first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deeds, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
