STATE OF GEORGIA COUNTY OF DOUGHERTY NOTICE OF SALE UNDER POWER CONTAINED IN SECURITY DEED Under and by virtue of the power of sale contained in that certain Security Deed from R & M MARKETPLACE INVESTMENTS, LLC (hereinafter referred to as "Grantor") to HERITAGEBANK OF THE SOUTH n/k/a RENASANT BANK (the "Bank"), having an address at 721 N. Westover, Albany, GA 31721 (hereinafter referred to as "Grantee"), dated January 17, 2014, and recorded on January 21, 2014 in Deed Book 4095, Page 194-204, in the Office of the Clerk of the Superior Court of Dougherty County, Georgia, which was subsequently assigned to RENASANT BANK in a Promissory Note dated February 24, 2015; said Security Deed secures payment of that certain Note, and any modifications thereof, given by R & M MARKETPLACE INVESTMENTS, LLC in favor of the Bank, in the original principal amount of SEVENTY-EIGHT THOUSAND SEVEN HUNDRED EIGHTY-ONE AND 50/100 DOLLARS ($78,781.50) there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Dougherty County, Georgia, within the legal hours of sale on the first Tuesday in September of 2019, namely September 3, 2019, the property conveyed by said Security Deed and described as follows, towit: All that tract or parcel of land lying and being in the City of Albany, Dougherty County, Georgia, and being more particularly described as: all of lot 24 of Gloriana Subdivision, revision of Block A and Block B, according to the plat of the subdivision as is recorded in Plat Cabinet 1, Slide C 79-H, in the Office of the Clerk of Superior Court of Dougherty County, Georgia (note: Lot 24 is comprised of part of Lots 27 and 28 of the original Gloriana Subdivision, recorded in Deed Book 14, Page 389). Subject to conditions and restrictions as outlined in letter of December 20, 2006, from Jennifer Clark, Director of Community and Economic Development to Marion Mitchell, expressly incorporated herein, which shall run with the property in perpetuity and are specifically incorporated herein by reference. The property is located in Dougherty County, 413 Corn Ave., Albany, Georgia 31701. Because of the default in the payment of the installments due under the Note which the Security Deed was given to secure, the undersigned has declared the entire indebtedness due and payable, and said property will be sold as the property of Grantor to satisfy the indebtedness evidenced by the Note together with the cost of said sale, including attorney's fees, notice having been given pursuant to the Official Code of Georgia Annotated Section 13111. To the best of the undersigned's knowledge and belief, the party in possession of said property is Grantor or tenants claiming by, through or under Grantor. Said property will be sold subject to all liens, zoning ordinances, encumbrances, easements, covenants, restrictions and other matters of record to which the Security Deed is junior and inferior in terms of priority. Said property will be sold subject to any and all unpaid taxes or assessments relating to the property and all matters as would be disclosed by a current, accurate survey of the property. Said property will be sold on an "as-is, where-is" basis without recourse against Grantee and without representation and warranty of any kind or nature whatsoever with respect thereto. Said property will be sold subject to the right of redemption of any taxing authority. Grantee hereby reserves the right to suspend the foreclosure proceeding at any time prior to the acceptance of a bid and to subsequently resume the foreclosure proceeding at a time of its choosing or to rebid upon failure of a successful bidder to consummate the purchase.
