NOTICE OF SALE GEORGIA, DOUGHERTY COUNTY. By virtue of a power of sale contained in that certain Security Deed from BARBAR PROPERTIES, LLC to RENASANT BANK, dated February 25, 2016, and recorded in Deed Book 4296, Page 87, et seq., Dougherty County deed records, said Security Deed having originally been given to secure a certain Promissory Note, in the original principal amount of EIGHT HUNDRED ELEVEN THOUSAND FOUR HUNDRED EIGHTY SIX and 06/100 DOLLARS ($811,486.06) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by BARBAR PROPERTIES, LLC to RENASANT BANK, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Albany, Dougherty County, Georgia, within the legal hours of sale on the first Tuesday in April, 2021, the following described property: Tract 1 500 West Oglethorpe Boulevard Parcel 1: All that tract or parcel of land lying and being in the City of Albany, Dougherty County, Georgia, and being a part of Land Lot 334 in the First Land District or said county and also being a part of Lot 82, Block 22, of the original platted lots of the City of Albany and being more particularly described as follows: From a point formed by the intersection of the south right of way line of Oglethorpe A venue and the west right of way line of Monroe Street, which point in also the northeast corner of Lot 82, go south 87 degrees 15 minutes west along the south right of way line of Oglethorpe Avenue a distance of 102.5 feel to the point of beginning; thence continue south 87 degrees 15 minutes west along the south tight of way line of Oglethorpe A venue 57 .S feet to a point; thence go south 2 degrees 48 minutes east 210 feet to a point located on a twenty (20) foot public alley; thence go north 87 degrees 15 minutes east 57 .5 feet along the north right of way of said twenty (20) foot public alley to a point; thence go north 2 degrees 48 minutes west 210 feet to the point of beginning. And being the property conveyed to Gulf Oil Corporation by deed of October 27, 1964, and recorded in Office of Clerk, Superior Court, Dougherty County, GA in Deed Book 322, Page 430 Parcel II: All that tract or parcel of land situated, lying and being in the City of Albany, Dougherty County, Georgia, and being a part of Land Lot No. 334 in the First Land District of said county and also being a part of Lot 82, Block 22, of the original platted lots of the City of Albany and being more particularly described as follows: Begin at a point formed by the intersection of the south right of way line of Oglethorpe A venue and the west right of way line of Monroe Street, which point is also the northeast corner of Lot 82, and with this as a beginning point, go south 87 degrees 15 minutes west along the south right of way line of Oglethorpe Avenue a distance of 102.S feet to a point; thence go south 2 degrees 48 minutes east 210 feet to a point located on the north right of way of a twenty (20) foot public alley-, thence go north 87 degrees 15 minutes east 102.S feet to a point located on the West right of way line of Monroe Street; thence go north 2 degrees 48 minutes west along the west right of way line of Monroe Street 210 feet to the point of beginning. And being the property conveyed.to Gulf Oil Corporation by deed of Edna Lonsberg Farkas and Ruth Lansberg Tassman dated October 26, 1964, recorded in Office of Clerk, Superior Court, Dougherty County, GA in Book 324, Page 326. (Upon information and belief of Renasant Bank this property is known as 500 West Oglethorpe Blvd. according to the present system of numbering in place in Albany, Dougherty County, Georgia). Tract 28 511/515 West Oglethorpe Boulevard A tract or land located in Albany, Dougherty County, Georgia fronting approximately 97.5 feet on the north side of Oglethorpe Avenue and running back an equal within 210 feet to an alley said property being the lot on which the Samuel Raich Home was formerly located and known as 515 West Oglethorpe Avenue, Lot # 83 Commerce. (Upon information and belief of Renasant Bank this property is known as 515 West Oglethorpe Blvd. according to the present system of numbering in place in Albany, Dougherty County, Georgia). TRACT II: All that tract or parcel of land lying and being in the City of Albany, Dougherty County, Georgia and being further described as follows: Commencing at the southeast corner or said lot, thence run a line due west on Commerce Street (Oglethorpe Boulevard) one hundred and twelve (112) feet and six (6) inches; thence due north to the alley two hundred and ten (210) feet; thence due east on the alley one hundred and twelve (112) feet and six (6) inches; and thence due south to the starting point two hundred and ten (210) feet. (Upon information and belief of Renasant Bank this property is known as 511 West Oglethorpe Blvd. according to the present system of numbering in place in Albany, Dougherty County, Georgia). The indebtedness secured by the aforementioned Security Deed has been, and is hereby declared immediately due and payable in full because of the failure of BARBAR PROPERTIES, LLC and BARBAR1 PROPERTIES, LLC to maintain payments upon said indebtedness owing to RENASANT BANK, in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys fees. The above-described property will be sold as the property of BARBAR PROPERTIES, LLC and will be sold subject the following items which may affect the title to said property: as to the property at 500 West Oglethorpe Blvd. that certain Real Estate Deed to Secure Debt from Barbar Properties, LLC to HeritageBank of the South, dated October 5, 2010, and recorded October 11, 2010, in Deed Book 3746, Page 227, and re-recorded March 21, 2011, in Deed Book 3794, Page 262, Dougherty County, Georgia Public Deed Records, in the original principal amount of $201,921.00; as affected by Affidavit dated April 30, 2014, and recorded May 20, 2014, in Deed Book 4125, Page 37, aforesaid records; as to the properties at 511 and 515 West Oglethorpe Blvd. that certain Security Deed from Barbar Properties, LLC to HeritageBank of the South, dated December 21, 2009, and recorded January 12, 2010, in Deed Book 3672, Page 223, Dougherty County, Georgia Public Deed Records, in the original principal amount of $147,184.00; as affected by Affidavit dated April 30, 2014, and recorded May 20, 2014, in Deed Book 4125, Page 37, aforesaid records; all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all liens for solid waste and the like; all real property ad valorem taxes or assessments which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Security Deed described above; and all easements, restrictions, rights-of-way, Security Deeds or other encumbrances of record which have priority over the referenced Security Deed.
