NOTICE OF SALE GEORGIA, DOUGHERTY COUNTY. By virtue of a power of sale contained in that certain Security Deed from Larry Robinson and Michael Robinson to Philip Gary Malone, dated May 25, 2018, and recorded on May 25, 2018 in Deed Book 4512, Pages 246-248 in the Office of the Clerk of the Superior Court of Dougherty County, Georgia, said Security Deed had been given to secure that certain Promissory Note dated May 25, 2018 between Larry Robinson and Michael Robinson and Philip Gary Malone in the amount of $100,000.00, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description then or thereafter owing, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the Dougherty County Courthouse door at Albany, Dougherty County, Georgia, within the legal hours of sale on the first Tuesday in April, 2021, the following described property, with all improvements thereon: All that tract or parcel of land lying in Land Lot 188, First Land District, Dougherty County, Georgia, and being a part of portion of Lots 218, 223 and 226 Keystone Pecan Company Subdivision B, same being more particularly described as follows: Commence at the Southeast intersection of the Georgia Northern Railroad 100 foot right-of-way and Mock Road (120 foot right-of-way) and go thence South 20 degrees 10 minutes 06 seconds West a distance of 618.94 feet along the East right-of-way of Mock to the POINT OF BEGINNING; from this POINT OF BEGINNING, go thence South 37 degrees 07 minutes 43 seconds East along the West right-of-way of said Georgia Northern Railroad a distance of 132.94 feet to a point; go thence South 00 degrees 34 minutes 12 seconds West a distance of 29.17 feet to a point; go thence North 89 degrees 54 minutes 06 seconds West a distance of 631.77 feet to a point on the East right-of-way of Mock Road; go thence North 20 degrees 10 minutes 06 seconds East along the East right-of-way of Mock Road a distance of 143.73 feet to the POINT OF BEGINNING. Said property is further described as being Tract #4, containing 1.784 acres, according to the plat of survey attached as Exhibit A to that certain Warranty Deed from Marjory Oakley Nesbitt to Malones Paint & Body, Inc., dated December 19, 1997 and recorded in Deed Book 1767, Page 294, Dougherty County land records. Said plat is hereby incorporated into and made a part hereof by this express reference. Subject to a non-exclusive easement for ingress and egress to property lying north of the above described tract over and across the existing driveway from Mock Road onto the above described tract located near the north line of the above described tract. Said property has an address of 1440 South Mock Road under the present system of numbering streets in Albany, Dougherty County, Georgia. Notice is given that Philip Gary Malone, 917 Hansel Road, Ty Ty, Georgia 31795, telephone number (229) 347-6986, is the entity with authority to negotiate, amend, and modify the terms of the above-referenced Security Deed. The indebtedness secured by the aforementioned Security Deed has been, and is hereby declared immediately due and payable in full because of the failure of Larry Robinson and Michael Robinson to maintain payments upon said indebtedness owing to Philip Gary Malone in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys fees. The above-described property will be sold as the property of Larry Robinson and Michael Robinson, their heirs, successors or assigns and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all liens for solid waste and the like; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Security Deed described above; and all easements, restrictions, rights-of-way, security deeds or other encumbrances of record which have priority over the referenced Security Deed.
