NOTICE OF JUDICIAL TAX SALE GEORGIA, DOUGHERTY COUNTY On March 22, 2022, the Honorable Denise Marshall, Dougherty Superior Court Judge, entered an order (the "Order") in the matter of Shonna Colley Josey in her official capacity as Tax Director and Ex-Officio Sheriff of Dougherty County, Georgia (the "Petitioner"), against the following: the property hereinafter described and Cora C. Morgan, her heirs, executors, administrators and assigns and Lucious Morgan, his heirs, executors, administrators and assigns ("Respondents"), said matter designated as Civil Action File Number 22 CV 185 -1 in the Superior Court of Dougherty County, Georgia. The order provided, among other things, that: (i) the hereinafter described property be sold in accordance with O.C.G.A § 48-4-81, and pursuant to state law and Dougherty County Resolution Number 13-001, not earlier than 45 days following the date of issuance of the Order, subject to the redemption rights of the owners of record of the fee simple interest in the property as of February 18, 2022, the date of filing of the petition in the above-referenced matter, together with the owners' successors in interest by death or operation of law, to redeem the property upon payment into court of the full amount of the minimum bid price; and (ii) pursuant to O.C.G.A § 48-4-81(c) and (c)(2), only such owner's rights of redemption ("Owner's Right of Redemption) shall exist for 60 days after the date of the sale; and (iii) thereafter, the sale shall be final and binding. The property to be sold (the "Property") is described as follows: All that tract or parcel of land lying and being in the City of Albany, County of Dougherty, State of Georgia, and being more particularly described as follows: All of Lot 6 of Sunny Acres Subdivision Addition, as per a map or plat of said subdivision as recorded in Plat Book 2, Page 52, Clerks Office, Dougherty County, Georgia. Together with all rights, title and interest running with the above-described property but not taxed under a separate tax reference number as delineated on the tax maps of the petitioner for the year(s) for the taxes being foreclosed. The street address of the property is 515 Johnny W. Williams Road in Albany, Georgia 31701, and the Property is further designated as Tax Parcel 000BB/00012/030. The ad valorem taxes assessed against the Property for the years 2017 through 2021 have not been paid as evidenced by the various fifas against the Property recorded in the lien records of Dougherty County, Georgia. THEREFORE, according to the terms of the Order and the applicable law, the undersigned will, after proper advertise¬ment, sell the Property to the highest bidder, for cash, on the first Tuesday in June, 2022, between the legal hours of sale, before the Courthouse door in Dougherty County, Georgia. The Property will be sold as the property of Cora C. Morgan, her heirs, executors, administrators and assigns and Lucious Morgan, his heirs, executors, administrators and assigns and the sale will be subject to the following: (a) rights of redemption, if any, provided under federal law; (b) tax liens, if any, held by Georgia governmental entities other than Petitioner which are superior to the taxes identified in the petition in the matter by virtue of OCGA § 48-2-56(b); (c) the holder of easements and rights-of-way, if any, as provided in OCGA §48-4-77(1)(C); (d) the holders of the benefits or burdens of any real covenants and restrictions, if any, filed of record as of February 18, 2022, the date of the filing of the Petition; (e) taxes for the year 2022 and subsequent years not yet due and payable; (f) to any matters disclosed by an accurate survey and inspection of the Property; (g) to applicable zoning ordinances; and (h) to Owner's Right of Redemption. The proceeds of the sale will be used first to the payment of the unpaid taxes giving rise to this judicial tax sale, including principal, interest, penalties, attorneys fees and expenses, and the balance, if any, will be deposited into the Registry of the Clerk of Superior Court of Dougherty to be distributed by the Court to the interested parties, including the owner, as their interests appear and in the order of priority in which their interests exist according to law.
